• Advertising Data: If you use the free tier, limited data may be collected for delivering in-app ads.

2. Use of Your Information

3. Tracking Disclosure (Apple Requirement)

LiFit does not track you across third-party apps or websites.

We do not sell personal data, and we do not share data with advertisers for cross-app tracking purposes.

4. Photos, Media & Camera

If you upload photos or videos, LiFit stores them for social posting, profile features, and app functionality. Your media may be visible to other users depending on your in-app visibility settings. You may delete your content at any time.

5. Location Information

We only collect location data if you enable optional features such as gym discovery or nearby user features. You may disable location permissions at any time in your device settings, but certain features may not work.

6. Third-Party Services We Use

We use third-party service providers to operate the Services. These services may process or store data on our behalf:

• Firebase Authentication – account login and identity
• Firestore Database – storing workouts, posts, and app data
• Firebase Storage – storing photos and media
• Firebase Analytics – app analytics and performance metrics
• AdMob (if free tier used) – standard non-tracking ads

These providers are contractually required to protect your information and comply with Apple’s App Store requirements.

7. Data Sharing

We only share your information with:

• Vendors and service providers that support our app infrastructure
• Legal authorities if required to comply with the law
• Other users when you choose to post publicly or interact socially

These Terms of Service (“Terms”) govern your access to and use of the LiFit mobile application, website, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms.

1. Acknowledgment (Apple Requirement)

You acknowledge that this agreement is between you and LiFit only, not Apple. LiFit—not Apple—is solely responsible for the LiFit application (“Licensed Application”) and its content.

2. License (Apple Requirement)

LiFit grants you a non-exclusive, non-transferable license to use the Licensed Application on any Apple-branded device you own or control, in accordance with the Apple Media Services Terms and Conditions. The application may be used by other accounts associated with you via Family Sharing where supported.

3. Eligibility & Accounts

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Services. You are responsible for safeguarding your login credentials and for all activity under your account. Contact us immediately if you suspect unauthorized access.

4. Acceptable Use

You agree not to misuse the Services, including by:

• Posting illegal, harmful, or infringing content
• Attempting to gain unauthorized access to systems or accounts
• Interfering with system integrity or security
• Harassing or abusing other users

LiFit may remove content or suspend accounts that violate these Terms or applicable law.

5. User Content

You retain ownership of the content you submit (including photos, videos, posts, workouts, and comments). By submitting content, you grant LiFit a worldwide, royalty-free license to store, host, display, and process your content solely for operating and improving the Services.

6. Subscriptions & Payments

Certain features require a paid subscription (Premium or Pro). Pricing and renewal terms are shown in the app at purchase. Subscriptions automatically renew unless canceled before the renewal date in your Apple ID settings. Apple handles all billing and refund requests.

7. Maintenance & Support (Apple Requirement)

LiFit is solely responsible for providing maintenance and support for the Licensed Application. Apple has no obligation to provide support, maintenance, or updates for the application.

8. Warranty (Apple Requirement)

The Licensed Application is provided “as is” unless otherwise required by law. If the application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable). Apple has no further warranty responsibility. All other claims, losses, or liabilities related to the Licensed Application are the sole responsibility of LiFit.

9. Product Claims (Apple Requirement)

You acknowledge that LiFit—not Apple—is responsible for addressing any claims by you or third parties relating to the Licensed Application, including:

• Product liability claims
• Claims that the app fails to meet legal or regulatory requirements
• Claims under consumer protection, privacy, health, or similar laws

10. Intellectual Property Rights (Apple Requirement)

In the event a third party claims that the Licensed Application infringes their intellectual property rights, LiFit—not Apple—is solely responsible for the investigation, defense, settlement, and discharge of such claims.

11. Legal Compliance (Apple Requirement)

You represent and warrant that you are not:

• Located in a country subject to a U.S. Government embargo;
• Listed on any U.S. Government list of prohibited or restricted parties.

12. Third-Party Terms

Your use of the Services may be subject to additional third-party terms, including your wireless data provider, Firebase services, and other integrated third-party platforms. You agree to comply with all applicable third-party agreements.

13. Health & Safety Disclaimer

LiFit does not provide medical advice. Consult a qualified professional before beginning any workout program. Stop using the Services immediately if you experience dizziness, pain, or shortness of breath.

14. Limitation of Liability

To the fullest extent permitted by law, LiFit is not liable for indirect, incidental, or consequential damages. LiFit’s total liability in any 12-month period will not exceed the amount you paid (if any) during that period.

15. Termination

LiFit may suspend or terminate your access to the Services at any time. You may stop using the Services at any time. Sections on ownership, limitations, disclaimers, and liability survive termination.

16. Governing Law

These Terms are governed by the laws of the State of Texas, excluding conflict-of-law rules. Any disputes must be resolved in courts located in Travis County, Texas.

17. Third-Party Beneficiary (Apple Requirement)

You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce them against you as a third-party beneficiary.

18. Changes to These Terms

We may modify these Terms from time to time. If changes are significant, we will notify you through the app or email. Continued use after updates constitutes acceptance.
